ARTHURS QUAY MULTI-STOREY CAR PARK TERMS & CONDITIONS

These Terms and Conditions apply to any individual using the car parking services at Arthurs Quay Multi-Storey Car Park.

TCE Management CP Limited reserves the right to change and update these Terms and Conditions from time to time.

Please remember that the Car Park is open to the public, and it is not possible to guarantee the security of your vehicle or its contents.

1. Definitions

1.1 In these Terms and Conditions, any reference to ‘TCE Management CPLimited’, ‘we’, ‘us’ or ‘our’ refers to the operator of Arthurs Quay Multi-Storey Car Park.
1.2 Any reference to ‘Customer’, ‘you’, and ‘your’ refers to a person who has entered into a contract for the parking of a vehicle at the Car Park. By entering the car park, customers agree to be bound by these Terms and Conditions.
1.3 ‘Car Park’ means the parking facility operated by TCE Management CP Limited at Arthurs Quay Shopping Centre, Limerick.
1.4 ‘Our Representative(s)’ means any of our officers, agents, and employees acting in the course of business.
1.5 ‘Vehicle’ means any vehicle that enters the Car Park, including any mechanical device on wheels or tracks, its equipment, accessories, and everything that may be left in or on it.

2. Our Responsibilities and Liabilities

2.1 We have an obligation to you, in return for the parking charges paid or to be paid by you, to provide a space in the Car Park, if available, to park a Vehicle for the time allowed based on the amount paid or to be paid. We have no obligation to maintain custody over the vehicle or its contents.
2.2 You should be advised that the car parking areas are private property and managed by TCE Management CP Limited. We offer no warranty or indemnity as to the protection or safety of the vehicles left in the car parking areas or any goods left within the vehicles. The use of the car parking areas, and any services provided, is entirely at your own risk. TCE Management CP Limited and our Representatives accept no liability in respect of:
(a) Any loss, destruction, damage, or theft of or from the Vehicle or the contents of the vehicle; or
(b) Any death or personal injury sustained by you and/or any other person.
2.3 Nothing in these Terms and Conditions excludes or limits the liability of TCE Management CP Limited for:
(a) Death or personal injury caused by TCE Management CP Limited’s negligence;
(b) Any matter for which it would be illegal for TCE Management CP Limited to exclude or attempt to exclude its liability; or
(c) Fraud or fraudulent misrepresentation.
2.4 You will indemnify us against all claims, demands, and costs whatsoever arising out of or in connection with the presence of the Vehicle in the Car Park unless you can prove that the loss, damage, death, or injury was caused solely by the negligence or breach of statutory duty of us, our servants or agents.

3. Use of the Car Park

3.1 Any person who enters the Car Park agrees, in return for the use of the Car Park, to be bound by and comply with all of these Terms and Conditions.
3.2 Only the following people have permission to enter or remain in the Car
Park:
(a) Our authorised Representatives;
(b) Any owner of a Vehicle who comes into the Car Park to park it in connection with visiting Arthurs Quay Shopping Centre, or to collect and remove the Vehicle, provided that all charges due are paid before it is removed;
(c) Any passenger travelling in a Vehicle with the permission of its owner when the Vehicle is brought into the Car Park in connection with visiting Arthurs Quay Shopping Centre.
3.3 Permission is not given for vehicles of a type expressly excluded by notices at the entrance to the Car Park.
3.4 If you do not have permission to enter or remain in the Car Park, any Representative may require you to leave at any time and call for Garda assistance if necessary.
3.5 We are entitled to check whether anybody in the Car Park has permission to be there, and your cooperation is appreciated to help improve security.

4. Parking Charges

4.1 All parking charges are displayed on the tariff boards in the Car Park and on our website. We reserve the right to alter the parking charges at any time in our sole discretion. Any changes will be applied immediately.
4.2 Cashless payment may be made with debit or credit cards or other electronic means where available.

5. Safety and Security

5.1 Ensure your Vehicle is securely locked, and if an alarm is installed, it is activated.
5.2 When you park your Vehicle, you must:
(a) Lock your Vehicle securely;
(b) Close all windows of your Vehicle;
(c) Apply your handbrake properly;
(d) Engage any steering lock, alarm, or immobiliser;
(e) Not leave any animal or person within your Vehicle;
(f) Ensure your possessions are placed in a locked boot and not left in sight.
5.3 We cannot be held responsible for any loss or damage to your Vehicle or possessions within it.
5.4 Speed Limit: The maximum speed limit in the Car Park is 10 km/h.
5.5 You must drive carefully and responsibly, ensuring children and animals are properly supervised.
5.6 You must comply with all directional signage and other instructions when in the Car Park.

6. Moving of Vehicles

6.1 We or our Representatives reserve the right to move any Vehicle within or outside the Car Park if necessary for the efficient management of the parking facilities. Vehicles parked incorrectly may be towed away at your expense.

7. Warnings, Parking Charge Notices, and Clamping for Breaches

7.1 We are responsible for enforcing parking restrictions to ensure the free flow of traffic and safety. You must check that your Vehicle is parked according to the designated areas.
7.2 We or our Representatives may issue warnings, parking charge notices, and apply clamps for breaches of restrictions, including:
(a) Parking in an area not designated for parking;
(b) Parking beyond bay markings;
(c) Parking in a disabled space or Autism Friendly space without a valid badge/permit;
(d) Parking in an EV charging space without charging your vehicle.
7.3 Details of procedures for paying or appealing parking charge notices are provided on the back of each notice.

8. Abandoned Vehicles

8.1 We reserve the right to clamp any Vehicle believed to be abandoned. Vehicles left for more than 28 days may be considered abandoned.
8.2 We may charge a de-clamping fee for removing the clamp, and parking charges will continue to apply.

9. Liens

9.1 Vehicles are subject to a lien for all charges due. If charges are not satisfied within 56 days, we may sell the vehicle to recover costs.
9.2 Notice of intention to sell the vehicle will be given by affixing a notice to the Vehicle.

10. Prohibited Activities

10.1 You are not allowed to tow a Vehicle into the Car Park.
10.2 Sleeping or staying overnight in a Vehicle is prohibited.
10.3 Parking outside marked bays is prohibited.
10.4 The following activities are prohibited:
(a) Conducting service work or repairs to the Vehicle;
(b) Business activity in connection with selling, hiring, or disposal of the Vehicle;
(c) Refueling the vehicle;
(d) Misusing or damaging Car Park facilities;
(e) Driving dangerously;
(f) Making excessive noise;
(g) Filming or taking photographs;
(h) Cooking or lighting fires;
(i) Using camper van facilities;
(j) Engaging in criminal activities.
10.5 Permission to use the Car Park is automatically withdrawn if you or your passengers engage in any prohibited activities.
10.6 Vehicles may not be left in the Car Park for more than five consecutive days.

11. Reporting of Incidents and Claims

11.1 If you suffer loss or damage to your Vehicle or personal injury in the Car Park, you must report the incident to staff immediately and notify your insurance company.
11.2 Claims against us must be submitted within 48 hours of the incident.

12. Force Majeure

12.1 We are not liable for any lack of access to the car park caused by events beyond our control, such as natural disasters, terrorism, or strikes.

13. General

13.1 These Terms and Conditions do not affect your statutory rights.
13.2 We reserve the right to amend these Terms and Conditions at any time.
